LMIA

A Labour Market Impact Assessment (LMIA) refers to a document required by an employer in Canada to hire foreign workers. Hence, through LMIA, a foreigner can get a temporary work permit in Canada.   

The employee can apply for this temporary work permit after the employer gets LMIA. For the application, the employee needs (a) a copy of the LMIA, and the LMIA number, (b) job offer letter, and (c) contract.

If an LMIA is ‘positive’, it means that there is a need for a foreign workers and allows employers to hire one. ‘Negative’ LMIA confirms that there is no such need and a Canadian should be hired for that position.

Open Work Permit

Open Work Permit allows a foreign national to work for multiple employers throughout the country. It means that, unlike in LMIA, this permit is not restricted to a single employer and is not job specific.

You are eligible to apply for an Open Work Permit if you are an international student qualified for post-graduate work program, spouse of a skilled worker or an international student, or a dependent family member of someone who applied for permanent residence.

Post Graduation Work Permit

Post Graduation Work Permit (PGWP) is an open work permit meant for international students who are graduated from a Canadian Designated Learning Institution (DLI). The permit gives them freedom to work anywhere in the country. The work experience you gain during PGWP period is a great way to apply and qualify for permanent residence in the country. You need to apply for PGWP within 180 days after getting your final marks. To be eligible, you need to pursue a course of 8-month duration or more. Otherwise, you will not be qualified to apply. If the course duration is less than 2 years, the PGWP will be in equivalent duration as the course. That means, if the course is 10 months, the permit will be also 10 months. If the course duration is 16 months or more, PGWP will be 3 years.

Refugee Class

There are three categories of applications for refugee status in Canada.

  1. Persons in Need of Protection
  2. Convention Refugee
  3. Country of Asylum Class

The first category refers to those who are living in Canada and would face torture and unusual treatment if send back to their countries. The second category includes people who are living outside their country and fear prosecution based on religion, race, or political stand if they return to it. The Country of Asylum Class is for people living outside Canada and do not qualify as Convention Refugees. Also, they have been personally affected by human rights violation, armed conflicts, or civil wars.

Humanitarian and Compassionate Applications (H&C)

Humanitarian and Compassionate application is meant for people who are living in Canada without having a legal status and would experience unjust and undeserved suffering and hardship if they are asked to leave the country.

This provision comes as Section 25 of the Immigration and Refugee Protection Act (IRPA). The decision on the application is based on the discretion of approving authorities as they are given full freedom to do so.
