Refugee Class
There are three categories of applications for refugee status in Canada.
- Persons in Need of Protection
- Convention Refugee
- Country of Asylum Class
The first category refers to those who are living in Canada and would face torture and unusual treatment if send back to their countries. The second category includes people who are living outside their country and fear prosecution based on religion, race, or political stand if they return to it. The Country of Asylum Class is for people living outside Canada and do not qualify as Convention Refugees. Also, they have been personally affected by human rights violation, armed conflicts, or civil wars.
Humanitarian and Compassionate Applications (H&C)
Humanitarian and Compassionate application is meant for people who are living in Canada without having a legal status and would experience unjust and undeserved suffering and hardship if they are asked to leave the country.
This provision comes as Section 25 of the Immigration and Refugee Protection Act (IRPA). The decision on the application is based on the discretion of approving authorities as they are given full freedom to do so.
